Certain elements are required for a third-party special needs trust (SNT) to protect a beneficiary’s eligibility for public benefits. However, third-party special needs trusts substantially differ from first-party special needs trusts and offer considerably more flexibility. This flexibility is important because the abilities and needs of special-needs beneficiaries vary as widely as the aspirations and concerns of the Settlors. This session will explore leveraging this flexibility to tailor third-party SNTs to the beneficiary and Settlors’ unique circumstances and aspirations, ensuring the utmost protection and support for individuals with disabilities while adhering to crucial eligibility requirements for public benefits.
