Third-Party Trusts are no longer the Asset Protection safety net we once thought they were.  Clients move, get divorced, remarry, and get sued.  Beneficiaries may become disabled, divorce, remarry, or lose a job.  Different states have different rules applying to trusts - and spendthrift rules are viewed differently by different states.  Some courts are also finding creative ways to treat a beneficiary’s interest in a trust as a “property interest” and allowing creditors or divorcing spouses access.   We will explore and learn about the various legal trends, followed by drafting strategies to enhance asset protection of third party trusts so we can appropriately serve our clients.
