A trademark is typically an easily recognizable symbol, word or logo that identifies one company's particular product and distinguishes it from those of others. Trademarks can be registered or unregistered, and can be owned by any legal entity, such as a person or a company. Trademarks carry with them property rights, which can sometimes be established through actual use of the trademark, but generally require registration of the trademark. Certain jurisdictions require that the owner have registered the trademark in order to be able to enforce their rights against infringement.

This webinar will discuss the possibility of incorporating trademark law into your business law practice. It will provide an introduction into what a trademark is, when it is typically used, the process of registering a trademark, and why registration is important.

Practitioners will learn:

  • What a trademark is and how it differs from other types of intellectual property, such as copyrights and patents.
  • What types of products can be trademarked.
  • What characteristics a mark should have in order to qualify for trademark protection.
  • How property rights in a trademark can be established.
  • The process of registering a trademark and the potential consequences of failing to do so.
  • Circumstances under which the US Patent and Trademark Office will refuse registration.
