Estate Planning with Section 678 of the Internal Revenue Code

WHAT WE’LL COVER

As estate planners we often do not focus enough on how to achieve all of the benefits of trusts, e.g., the estate tax, divorce, creditor, spendthrift and incapacity protections, without incurring the huge federal income taxes generally applicable to trusts. This program educates estate planners on how their clients can have it all, and how, in their drafting, lawyers need not sacrifice any of their clients' stated objectives for wanting to use trusts in their estate planning. The program will include both explanation and sample forms, and will guide attendees through all of the relevant Internal Revenue Code and regulation sections.

The author of the 2016 book, Optimum Estate Planning, Mr. Blase will explain how clients can accomplish all of their stated objectives for using trusts in their estate planning by focusing on:

  • The use of Section 678 of the Internal Revenue Code to avoid the high federal income tax rates on trusts
  • The impact of the SECURE Act on trust drafting
  • Trust planning for married couples' IRAs and 401ks
  • Trust drafting for S corporations
  • Modifying existing irrevocable trusts to minimize income taxes
