What happens when your client – or their child or grandchild -- gets divorced? While estate planning attorneys would likely be uncomfortable counseling a happily married couple on the potential problems in the event of a divorce, they should nonetheless make clients aware.

This session will explore and navigate the complex intersection of estate planning and divorce and allow you to better serve your clients on these potential issues, including:

  • The ability (or inability) to reach the other spouse’s beneficial interest in a trust;
  • Anticipated inheritances;
  • Decanting existing trusts;
  • Working with the client’s divorce lawyer;
  • Can we “divorce-proof” documents even when divorce is not on the horizon?
