Description

Asset protection provisions differ between jurisdictions. In some states, domestic asset protection trusts (DAPTs) are statutorily supported, in others, such protections are not available. However, in jurisdictions that have not enacted DAPT legislation, third-party hybrid DAPTs may still provide substantial protections. This presentation explores first- and third-party DAPTs as asset protection vehicles. Course objectives: (1) Explore asset protection legislation and drafting generally; (2) Understand the differences between first- and third-party DAPTs; (3) Evaluate how to apply asset protection in a variety of client circumstances.
