This course/session will delve into the often challenging and unique circumstances presented in selecting a fiduciary in Elder Law. Various topics of discussion will include the various fiduciary roles that may arise in this context, the options in selecting a fiduciary, providing for checks and balances among multiple fiduciaries, planning for inevitable transitions and the unfortunate occasion of malfeasance or dissatisfaction, and ensuring fiduciaries remain accountable. Additionally, drafting of estate planning documents in such a manner so as to ensure the principal’s intentions are understood and able to be met, as well as provide or the foregoing, will be addressed.
