By following specific nationally published rules, you can do that, without triggering SSI and Medicaid transfer penalties and also without income tax consequences, ISM deductions, ongoing reporting to SSI or Medicaid, and Medicaid payback! Pooled and individual Special Needs Trusts (SNTs) are often considered the default planning tool for individuals with disabilities, but they are not always the best or only solution. This program will examine situations where an SNT may not be the most cost-efficient solution to legally shelter small to even large excess resource amounts. In this session, we will explore a range of alternative strategies that can maximize public benefits and provide simpler and more effective solutions for individuals and families than SNTs. And they are all based on rules continually published since January 2000 and recently approved by the Social Security Administration and a state supreme court for Medicaid.
