While community property lawyers usually have a working knowledge of common law marital property rules, most lawyers in non-community property states lack a corresponding knowledge of community property law. Understanding community property law is important because it affects spousal rights to dispose and manage property during marriage, at divorce, and at death; creditor rights in the property of spouses; and taxation. Community property does not stop at the state line, but rather follows a couple as they move state-to-state. This presentation provides the background a common law lawyer needs to address community property issues.
