Clients with second or third marriages or blended families raise special estate planning considerations. The estate plan may include marital agreements or address children from current and previous marriages. The need for Medicaid planning can upend such estate plans. When applying for Medicaid, the assets of both spouses are at risk regardless of prenuptial or postnuptial agreements, giving rise to potential conflicts of interest between spouses as well as disputes between the spouses and surviving children.
To ensure effective Medicaid planning in such situations, attorneys should recognize and address common ethical issues and pursue strategies including certain types of trusts.
