This presentation will explore the impact of home DNA test kits, such as 23andMe®, on estate planning. It will examine the nature and prevalence of such at-home genetic testing and address how such testing can impact both probate and estate planning considerations, not just for the millions who actually engage in such testing, but also for clients who do not intend to partake personally, but who may have genetic relatives who do. As part of the analysis, the presenter will guide attendees through relevant provisions of the Uniform Probate Code, the Uniform Parentage Act, and a sampling of state-specific statutes and caselaw. The presentation will also offer practitioners some real-world considerations and drafting language that may impact their drafting choices moving forward.
