Non-Judicial Settlement Agreements: A Practical Approach

If you've ever represented a client during a trust administration, chances are you've encountered trust provisions that make the administration difficult, result in unfortunate income or estate tax consequences, or that are ambiguous. Petitioning a court to modify a trust can be time consuming and expensive. As an alternative, most states allow nonjudicial settlement agreements to be used to resolve uncertainty regarding irrevocable trust administration.

In this webinar we will explore the types of issues that can be resolved with nonjudicial settlement agreements and those that cannot. We will also discuss the structure for these types of agreements, who must sign, and related representation statutes. In addition to reviewing Section 111 of the Uniform Trust Code on nonjudicial settlement agreements, we will also review a sampling of some states' trust code provisions regarding the same.
