Asset protection is a concern for many clients, whether they want to create protections from their own or their beneficiary's spendthrift habits, creditors, or predators. The Asset Protection Intensive will cover a number of common strategies for creating asset protection, starting with the fundamentals and then moving into focused discussions of LLCs, different forms of ownership, and trust structures that can be used to fortify plans and create asset protection. The final session of this precursor will address drafting considerations for several strategies discussed throughout the day. This precursor is suitable for practitioners of all experience levels.

The population in our country is aging. The US population of individuals over 65 grew nearly five times faster than the overall population in the 100 years between 1920 and 2020. There are many special considerations involved in planning for aging clients. The Planning for an Aging Population precursor will first address the realities of practicing in a modern elder law practice and then move into a discussion of strategies for managing capacity concerns, how to help aging clients choose the right fiduciaries and agents, and tax implications that may be uniquely important to consider for this demographic.
